Missouri Lemon law factsIf you purchase a new or used car or other motor vehicle and it proves to be defective and the manufacturer can not fix it despite repeated efforts to do so within a specified time period, your car may qualify. If your vehicle is out of service for a specified period of time due to its defects, you may also qualify. You may be entitled to a wide range of damages including money damages, a refund or a new car. The statutes themselves are a group of consumer protection statutes that provide you with certain rights if you have purchased or leased a defective automobile or other motor vehicle covered by a manufacturer's warranty. State statute covers vehicles sold, transferred or leased, in the state, and used primarily for personal, family or household purposes. The statute excludes commercial vehicles, mopeds, motorcycles and RVs except for the chassis, engine, power train and component parts of RVs. You may qualify for relief if, during the earlier of the express warranty period or one year following purchase, your vehicle has had at least four attempts to repair the same defect and the defect still exists or your vehicle has been out of service for at least 30 working days. If you qualify for relief, the manufacturer must replace the defective vehicle with a vehicle acceptable to you or accept the return of the vehicle and refund full purchase price plus all collateral and incidental charges less a reasonable allowance for your use. |
