The Kentucky lemon law provides you with certain legal rights if your defective motor vehicle, purchased or leased in state, was covered by a manufacturer's warranty. Closely related to the Kentucky lemon law are two other statutes - the Magnuson-Moss Act (known as the Federal Warranty Law) and the Uniform Commercial Code. These three consumer protection statutes form a powerful tool to protect you from defective vehicles.

Federal and State laws designed to protect the consumer

If your car is a real lemon, it is not worth much if you don't do anything about it. However, if you decide to take action, you do have federal and state law on your side. Under the state statute, any vehicle owned by a resident and purchased or leased new and registered or licensed in the state, except conversion vans, motor homes, mopeds, motorcycles, farm equipment and vehicles with more than two axles are covered. The vehicle may qualify if it has had four attempted repairs that have failed within the first year or 12,000 miles or has been out of service for 30 calendar days within the first year or 12,000 miles, whichever occurs first.

By state law, the manufacturer shall at the consumer's option replace the vehicle with a vehicle of equal value or accept the return of the vehicle and refund purchase price plus all collateral charges less a reasonable allowance for consumer use.

In addition, the Magnuson Moss Warranty Act is the federal statute that governs consumer product warranties. It affects both the rights of the consumer and the obligations of warrantors under written warranties. Passed by Congress in 1975, the Act requires manufacturers and sellers of consumer products to provide consumers with detailed information about warranty coverage.

The Magnuson Moss Warranty Act makes it easier for consumers to get their money back because it makes a breach of warranty a violation of federal statute. It also allows consumers, if they prevail in court, to recover court costs and reasonable attorney fees in addition to recovering damages for their defective product.
