We know how to combine the consumer protections afforded under the state statute, the Uniform Commercial Code and the Magnuson Moss Warranty Act to get you the best possible results in court. The Lemon Laws - designed specifically to aid the consumerIf you bought a defective motor vehicle you know it is not worth much if you can't drive it and it just sits in the garage. However, based on both the state and federal statute, you can do something about it. You now have a wide range of options to get compensated for buying a defective vehicle. The statute covers any motor vehicle sold to a buyer in Indiana and registered in Indiana, vehicles purchased in the state by a nonresident, vehicles having a GVW of less than 10,000 pounds, excluding conversion vans, motor homes, farm tractors, road building equipment or vehicles designed primarily for off-road use. You may qualify for relief if, during the first 18 months following purchase or 18,000 miles (whichever occurs first), your vehicle has had at least four attempts to repair a defect and the defect still exists or your vehicle has been out of service for at least 30 business days. If you qualify for relief, the manufacturer, at your option, must replace the vehicle with a comparable vehicle or accept the return of the vehicle and refund the purchase price plus taxes, fees, finance charges and towing and rental costs less a reasonable allowance for your use of the vehicle. Good advice for future purchasesAlways thoroughly research the vehicles that you are considering purchasing. Study car magazines and information on the Internet to find if the particular car you are considering has had any problems in the past. At the dealer, don't be afraid to ask questions. Always test drive the car before you purchase. Drive it on rough pavement, tight corners and expressways. Turn off the radio and listen for suspicious noises. And, most importantly, get everything in writing including warranty information and anything else related to your purchase and save it. Get verbal promises in writing. Remember, there are statutes that will protect you, but you must first protect yourself.
